Language Note: These Terms and Conditions are available in both English and Arabic. In the event of any inconsistency between the two versions, the Arabic version shall prevail to the extent required by applicable UAE law.

Our Terms of Use

By signing up for an account with ShopCash, you hereby agree to be bound by these Terms of Use. ShopCash will provide reasonable advance notice of any material amendments to these terms via email or platform notification prior to such amendments taking effect.

ShopCash General Terms of Use

ShopCash FZ-LLC ("ShopCash") offers, amongst other things, cashback to ShopCash account holders for purchases made at ShopCash's merchant partners through ShopCash's various platforms, including but not limited to its website and mobile application (the "ShopCash Platforms"). The use of the services (the "Services") offered on the ShopCash Platforms, and accounts maintained with ShopCash shall be subject to these terms and conditions (the "Agreement"). This Agreement constitutes a legally binding agreement between each individual who uses the Services or who maintains an account with ShopCash. By using any of the Services or maintaining an account with ShopCash, you acknowledge that you have read and understood this Agreement and agree to be bound by all of its terms.

ShopCash may modify this Agreement from time to time. Where ShopCash makes material changes to this Agreement, it will notify you via email or platform notification at least fourteen (14) days prior to such changes taking effect. Your continued use of any of the Services or continued maintenance of an account with ShopCash following the notification period shall constitute your acceptance of such modifications and your consent to abide by the amended terms.

Service License
Subject to this Agreement, ShopCash hereby grants you a revocable, non-exclusive, non-transferable license (without the right to sublicense) to access and use the ShopCash Platforms and the Services solely for your personal use. You agree that you obtain no rights other than the rights and licenses expressly granted under this Agreement. ShopCash reserves the right to change, upgrade, or discontinue any or all of the Services or the ShopCash Platforms at any time, with reasonable prior notice where practicable. All rights not expressly granted under this Agreement are reserved by ShopCash and its licensors.
Eligibility
You represent and warrant that you are at least eighteen (18) years of age and have full legal capacity to enter into this Agreement.
If you are under the age of eighteen (18), you may not use the Services or create an account except under the supervision and with the express consent of your legal guardian. ShopCash reserves the right to request age verification documents at any time and may suspend accounts where eligibility cannot be confirmed.
ShopCash Account
Some of the Services require the user to maintain an account with ShopCash. A user may create an account free of charge by providing the relevant details requested. Use of the account and the Services (including the opportunity to earn cashback) is offered at the sole discretion of ShopCash and is subject to your compliance with this Agreement.
An individual shall not create or have control and/or custody over multiple ShopCash accounts. In particular:
(a) Each email address may only be linked to one ShopCash account;
(b) Each mobile number may only be linked to one ShopCash account;
(c) Each payment account (e.g., each bank account) may only be linked to one ShopCash account.
A failure to abide by any terms and conditions, any fraud or abuse relating to the accrual or receipt of cashback and/or other rewards, and/or any misrepresentation of any information furnished to ShopCash or its affiliates may result in your ShopCash account being flagged for suspicious activity, suspended, or terminated, and any cashback accumulated being forfeited.
You are responsible for regularly checking your account to ensure cashback has been properly credited and that your account balance is up to date. You must notify ShopCash of any omissions, incorrect entries, or discrepancies concerning any transaction within 30 days after that transaction. ShopCash reserves the right not to correct any omissions, incorrect entries, or discrepancies brought to its attention after the 30-day period.
Use Restrictions
You hereby agree not to:
Use the ShopCash Platforms in any manner that may damage, disable, overburden, or impair them or interfere with other users' use;
Use any automated systems (including scraping, crawling, or data extraction tools) to access the Platforms or content;
Attempt to gain unauthorised access to any part of the Platforms or related systems;
Use the Services in violation of any applicable laws or regulations in the United Arab Emirates, Kingdom of Saudi Arabia, or any other applicable jurisdiction;
Misuse or manipulate cashback programs, promotions, or offers in any way.
Release
To the fullest extent permitted by applicable law, including the UAE Consumer Protection Law (Federal Law No. 15 of 2020), you agree to release, discharge, and hold harmless ShopCash, its officers, employees, and agents from any and all claims, losses, damages, or liabilities arising out of or related to your use of the Services or breach of this Agreement. This release does not affect any rights you may have under applicable mandatory consumer protection law.
User Representations
You represent and warrant that all information provided to ShopCash is true, accurate, complete, and up to date.
You shall be solely responsible for any incorrect or misleading information provided. ShopCash reserves the right to suspend or terminate your account if any information is found to be inaccurate, without prejudice to any other legal rights.
Earning Cashback
Among the services offered by ShopCash is the opportunity to earn cashback on purchases made at our various merchant partners through our various ShopCash Platforms. Creating and maintaining an account with ShopCash is required before a user can start earning cashback. Crediting of cashback is subject to the various terms, conditions, and requirements, express or implied, associated with the crediting of cashback in general or with individual promotions. These terms, conditions, and requirements include, but are not limited to:
(a) Accessing the merchant partner's website exclusively through a valid ShopCash referral link or platform redirect;
(b) Completing the full transaction session without interruption via the ShopCash platform before being redirected;
(c) Requiring the user to have cookies enabled throughout when accessing the ShopCash Platforms and subsequently the merchant partner's website;
(d) Not opening a separate tab or browser while accessing the ShopCash Platforms and subsequently the merchant partner's website;
(e) Ensuring that after being redirected to the merchant partner's website, the user completes the transaction before proceeding to any other website;
(f) Completing the purchase on the merchant's website within a given period of time;
(g) Not engaging in any fraudulent or dishonest conduct and/or abiding by the terms of this Agreement or any other terms and conditions stipulated by ShopCash or the applicable merchant partner.
In addition, certain purchases may be excluded from cashback. In general, cashback is earned on the net purchase amount, excluding shipping and handling. Cashback amounts and exclusions vary from merchant partner to merchant partner, and individual promotions may contain specific exclusions. These exclusions are subject to change without notice. Some examples of typical exclusions include (but are not limited to):
(a) Cashback not being eligible when purchasing promotional items or using other discount codes, coupons, or other promotions;
(b) Cashback only being eligible when the transaction is completed using specified payment methods; and
(c) Different tiers of eligible cashback for different users (e.g., different tiers for new users and existing users).
ShopCash reserves the right to modify cashback rates, merchant partner terms, and promotional offers at any time. Where changes are material, ShopCash will endeavour to provide reasonable prior notice via email or platform notification.
Merchant Partner Policies
Any products or services purchased from any merchant partner, whether through ShopCash or otherwise, are governed by and subject to the applicable merchant partner's policies and terms and conditions, including but not limited to the applicable return, cancellation, exchange, and shipping policies. You agree that we are not agents of any merchant partner and that the merchant partner operates independently and not under our control. Accordingly, your participation in offers or promotions of, or correspondence with, any merchant partner is solely between you and that merchant partner. ShopCash is not responsible for changes to, or discontinuance of, any merchant partner from any of ShopCash's platforms, or for any effect on accrual of cashback caused by such changes, discontinuance, or withdrawal. ShopCash assumes no responsibility and shall not be liable for any content, product, and/or services on the merchant's platforms, including but not limited to the quality, merchantability, or fitness of such products or services.
Top-ups and Deductions
ShopCash reserves the right from time to time to make top-ups and deductions from the balance in a user's account where it is necessary, reasonable, or expedient to do so. This includes (but is not limited to) situations where cashback has been incorrectly credited into a user's account and/or where a user is found to have acted fraudulently, dishonestly, or in contravention of the terms of this Agreement. ShopCash will provide reasonable notification of any deductions to the affected user, except where doing so would prejudice fraud investigations or ongoing legal proceedings.
Cash Back Payments
The minimum payment amount for cashback and other Cashback Program rewards will vary depending on your country of residence and will be determined by ShopCash and displayed on the ShopCash Platforms. Balances below the applicable threshold will remain in your account for potential payment during the next payment period, or may be withdrawn immediately (where available) once the applicable minimum withdrawal amount is reached. ShopCash pays members via bank transfer or other payment options, which may include, but are not limited to, gift cards and wallet transfers, as ShopCash may make available from time to time. Members may select or change their payment options in the account settings through the ShopCash Platforms.
ShopCash pays its members accrued cashback and cashback program-related rewards in accordance with the current payment schedule. Accrual rates vary depending on the merchant partner's policies and reporting schedules. For example, cashback for travel-related purchases typically does not accrue until after travel has been completed. ShopCash reserves the right to delay payment for any purchase based on changes to merchant partner policies at any time and reserves the right to modify the payment schedule with reasonable prior notice. ShopCash reserves the right to withhold or refuse payment where it reasonably suspects fraud, abuse, or breach of this Agreement. ShopCash may take such action immediately and without prior notice where reasonably necessary to prevent harm, fraud, or regulatory breach.
All cashback payments will be made in the local currency applicable to your location or selected payment method. Users are responsible for any bank charges, currency conversion costs, or transfer fees charged by their financial institution. ShopCash complies with applicable tax laws and regulations, including UAE VAT requirements where applicable; users should seek independent tax advice if uncertain of their obligations.
Nature of Cashback
For the avoidance of doubt, you do not gain any proprietary right over any monies or assets held by ShopCash when you earn cashback in your account. The cashback accrued in your account does not constitute monies held on trust by ShopCash for your benefit. Cashback does not constitute stored value, electronic money, a deposit product, or a regulated payment service under applicable UAE laws. Your rights and entitlements are solely limited to such personal or contractual rights of repayment as may arise out of this Agreement.
Termination of Account and Cashback Expiry
The cashback accumulated in your ShopCash account shall expire if your account remains inactive (i.e., no successful transactions are made through ShopCash) for a period of more than twelve (12) months. Prior to any such expiry, ShopCash will send a notification to your registered email address at least thirty (30) days in advance, providing you with an opportunity to redeem your balance or reactivate your account before the balance is forfeited.
ShopCash reserves the right to suspend or terminate your account where it is necessary or reasonable to do so in order to comply with any law, regulation, or court order, or in accordance with Clause 16 (Fraud) of this Agreement.
Personal Data Protection
Personal data collected from you is processed in accordance with our Privacy Policy, which is incorporated by reference into this Agreement and is available on the ShopCash Platforms. ShopCash processes personal data in compliance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL) and any implementing regulations thereunder. We retain your personal data for as long as your account is active and for 3 years thereafter in accordance with our legal obligations.
As a data subject under the PDPL, you have the following rights in respect of your personal data:
(a) The right to access your personal data held by ShopCash;
(b) The right to request rectification of inaccurate personal data;
(c) The right to request erasure of your personal data, subject to applicable legal obligations;
(d) The right to request restriction of processing;
(e) The right to object to processing; and
(f) The right to request portability of your personal data in a commonly used electronic format.
To exercise any of the above rights, please contact ShopCash at [email protected]. ShopCash will respond to valid requests within thirty (30) days.
ShopCash uses cookies to enable key functionality, including the tracking of cashback-eligible transactions. By using the ShopCash Platforms, you consent to the use of cookies as described in our Cookie Policy, available on the ShopCash Platforms. Disabling cookies may affect your ability to earn cashback. Where personal data is transferred outside the UAE, ShopCash will ensure appropriate safeguards are in place consistent with the requirements of the PDPL.
Bonuses and Rewards
ShopCash periodically offers bonuses or rewards for performing certain actions (such as referring new users to ShopCash). The terms and conditions accompanying such offers will govern how they are earned and paid. You are prohibited from bidding on keywords containing 'ShopCash' or other similar words or marks for the purpose of driving traffic to your page. You shall not send any paid traffic directly to your referral link. You may not include or distribute your referral link on any website or platform that does not belong to you, such as social media pages belonging to merchants or forum pages belonging to third parties.
Taxes
You are responsible for any and all taxes that may apply to amounts earned from cashback you have redeemed, in accordance with the laws of your applicable jurisdiction. ShopCash makes no representation as to the tax treatment of such amounts and recommends that you consult a qualified tax advisor if you are uncertain of your obligations.
Fraud
ShopCash may suspend or terminate your account if it has reason to believe you are involved in any fraudulent or dishonest activities. Any failure to comply with this Agreement, any fraud, dishonesty, or abuse relating to the use of the Services or your account, or any misrepresentation of any information furnished to ShopCash or its affiliates by you or anyone acting on your behalf, may result in the termination of your account and forfeiture of your accrued cashback rewards. ShopCash cooperates with relevant law enforcement and regulatory authorities in the investigation and prosecution of fraudulent activity.
Customer Complaints and Escalation Process
ShopCash is committed to resolving disputes promptly and fairly. If you have a complaint or dispute regarding your account, cashback, or any aspect of the Services, you should follow the escalation process set out below before initiating any formal legal or arbitral proceedings:
Step 1 — Contact Customer Support: Submit your complaint via the in-app support feature or by emailing [email protected]. ShopCash aims to acknowledge all complaints within 2 business days and resolve them within 14 business days.
Step 2 — Escalation to Management: If you are not satisfied with the response, you may escalate in writing to [email protected]. A senior representative will review and respond within 7 business days.
Step 3 — Formal Dispute Resolution: If the complaint remains unresolved following the above steps, the matter may be referred to arbitration in accordance with Clause 27 of this Agreement. Nothing in this clause prevents you from filing a complaint with the UAE Consumer Protection Authority or other competent regulatory body.
Nothing in this clause shall prevent either party from seeking urgent injunctive or interim relief from a competent court where necessary.
Anti-Money Laundering and Know Your Customer
ShopCash is committed to complying with applicable anti-money laundering (AML) and counter-terrorism financing (CTF) laws and regulations in the UAE, including UAE Federal Decree-Law No. 20 of 2018 on Anti-Money Laundering and Combating the Financing of Terrorism. As part of this commitment, ShopCash may:
Request identity verification documents (KYC) from you at any time, including prior to processing withdrawal requests above certain thresholds;
Delay or withhold payment of cashback balances pending satisfactory completion of identity verification;
Suspend or terminate your account where verification requirements are not met or where suspicious activity is identified;
Report suspicious activity to relevant regulatory or law enforcement authorities as required by law.
You agree to cooperate fully with any such verification requirements and to provide accurate and complete information and documentation upon request.
Third Party Rights
A person who is not a party to this Agreement has no right to enforce any terms of this Agreement.
Communications
By becoming a ShopCash user, you agree to receive communications that are account and user related (e.g., notifications that cashback has been added to your account, or that payment has been made to your bank account) as well as periodic shopping-related communications highlighting coupons or special deals available to ShopCash users. ShopCash may communicate with you via email, push notification, or other available channels using information you provide during the registration process. You agree to keep ShopCash informed of your current contact details. You may opt out of non-essential marketing communications at any time by adjusting your preferences in account settings.
Ownership
All rights, title, and interest in the Services, the ShopCash Platforms, and the content associated with or on the same belong to ShopCash or its licensors. ShopCash maintains all rights, title, and interest in 'ShopCash', the logo, and any other marks, service marks, trademarks, or logos of ShopCash (the 'ShopCash Marks') that are registered in the United Arab Emirates, Kingdom of Saudi Arabia, and other countries. The ShopCash Marks may not be used in connection with any non-ShopCash product or service in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits ShopCash.
You shall not bid on, apply for, register, own, or control any keywords or marks containing 'ShopCash' or anything substantially similar, including without limitation ShopCash.com, ShopCash.ae, or ShopCash.sa, with any search engine, domain service provider, or intellectual property office. You shall not use ShopCash's name or marks in any advertisement, extension, or banner without the express written consent of ShopCash. All other trademarks not owned by ShopCash that are used in providing the Services are the property of their respective owners.
If you believe that any content on the ShopCash Platforms infringes your intellectual property rights, please notify ShopCash in writing at [email protected] with details of the alleged infringement. ShopCash will investigate and respond to valid notices in a timely manner.
Community Standards
By creating a ShopCash account, you are becoming a member of a community that depends on the goodwill and responsible behaviour of each of our users. Users are required to refrain from transmission or communication of images or text constituting ethnic slurs, obscenities, sexually explicit material, inflammatory or derogatory comments, or anything else that may be construed as harassing or offensive, whether targeted at the Services, the ShopCash Platforms, our employees, contractors, agents, merchant partners, or other users. This includes communications by means of social media or other internet posts that promote or encourage gaming or fraudulent behaviour. Users who violate this provision, as determined by ShopCash in its absolute discretion, may have their accounts suspended or terminated without prior notice.
Indemnification
You agree to indemnify ShopCash, any merchant partners, as well as their respective officers, directors, employees, successors, agents, and affiliates, for any and all claims, damages, losses, and causes of action (including legal fees and court costs) arising out of or relating to your breach of this Agreement or for any materials in any form whatsoever that are provided by you (or through your username and/or password). You agree to cooperate as fully as reasonably required in our defence and/or settlement of any claim. We reserve the right, in our reasonable discretion, to assume exclusive control over the defence and settlement of any matter subject to indemnification by you.
Warranty Disclaimer
The Services, content, and the ShopCash Platforms are provided "as is" and without warranty of any kind, express or implied, including, without limitation, warranties of title, merchantability, fitness for a particular purpose, or non-infringement. We make no warranty as to the quality, accuracy, completeness, reliability, or validity of the Services, content, or the ShopCash Platforms. ShopCash does not warrant that the functionality of the ShopCash Platforms will be uninterrupted or error-free, that defects will be corrected, or that they will be free of viruses or other harmful content. Nothing in this disclaimer shall exclude any liability that cannot be excluded under applicable UAE law.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall ShopCash be liable for any special, incidental, consequential, exemplary, punitive, or other indirect damages, or for any loss of profits, loss of data, or loss of use damages, even if it has been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, ShopCash's maximum aggregate liability arising out of this Agreement shall not exceed the total value of cashback credited to your ShopCash account in the twelve (12) months immediately preceding the event giving rise to the claim, or an amount equivalent to AED 1,000 in the local currency applicable to your location, as determined by ShopCash, whichever is greater.
Nothing in this clause shall limit ShopCash's liability for death or personal injury caused by its negligence, fraud, or any other liability that cannot be excluded by applicable law.
Force Majeure
ShopCash shall not be liable for any delay or failure to perform its obligations under this Agreement to the extent that such delay or failure results from events, circumstances, or causes beyond its reasonable control. Such events include, without limitation: acts of God, pandemics, government actions or restrictions, war, civil unrest, cyberattacks, failure of third-party payment processors or merchant partner systems, internet or telecommunications outages, or changes in applicable law or regulation. In such circumstances, ShopCash will endeavour to resume normal operations as soon as reasonably practicable and will communicate updates to affected users through available channels. If such an event continues for more than sixty (60) days and ShopCash is unable to resume the affected Services, ShopCash may elect to suspend or discontinue the affected Services upon providing users with reasonable notice. Any cashback accrued in user accounts prior to such suspension or discontinuance shall remain payable to users in accordance with the terms of this Agreement and shall not be affected by this clause.
Governing Law and Arbitration
This Agreement is governed by and construed in accordance with the laws of the United Arab Emirates.
Subject to Clause 17 (Customer Complaints and Escalation Process), any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity, or termination that cannot be resolved through the complaints escalation process, shall be referred to and finally resolved by arbitration administered by the Dubai International Arbitration Centre (DIAC) in accordance with the DIAC Arbitration Rules 2022 (as amended from time to time), which are deemed to be incorporated by reference into this clause. The seat of arbitration shall be Dubai, United Arab Emirates. The tribunal shall consist of one arbitrator. The language of the arbitration shall be English.
Notwithstanding the foregoing, certain matters may not be subject to arbitration under applicable UAE law, including UAE Federal Arbitration Law No. 6 of 2018, and nothing in this clause shall be construed to override such mandatory legal requirements. If you are a consumer resident in a jurisdiction that grants you the right to bring claims before local courts or consumer protection bodies, nothing in this arbitration clause shall deprive you of such rights to the extent guaranteed by applicable mandatory law.
Assignment
You may not assign your rights and obligations under this Agreement, in whole or in part, without prior written consent from ShopCash, and any such assignment without such consent will be null and void. ShopCash may assign this Agreement to any affiliate or successor entity, provided that ShopCash notifies you of such assignment and the assignee assumes all obligations under this Agreement.
Mobile Application and App Store Terms
If you access the ShopCash Services through a mobile application downloaded from a third-party app store (including the Apple App Store or Google Play Store), your use of the application is also subject to the terms and conditions of the applicable app store provider. In the event of any conflict between this Agreement and such third-party terms, this Agreement shall govern your relationship with ShopCash. ShopCash is solely responsible for the ShopCash mobile application and its content; the relevant app store provider has no obligation to provide maintenance or support services in connection with the ShopCash application.
Headings
Headings under this Agreement are intended only for convenience and shall not affect the interpretation of this Agreement.
Waivers and Severability
Any failure to enforce any provision of this Agreement on the part of ShopCash will not be deemed a waiver of that provision. Any waiver of any provision of this Agreement by ShopCash on one occasion will not be deemed a waiver of any other provision or of such provision on any other occasion. If any provision of this Agreement is held to be invalid or unenforceable under applicable law, such invalidity or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect.
Notices and Amendments
ShopCash will notify you of material updates to this Agreement via email to your registered email address and/or via platform notifications. For material changes, ShopCash will provide at least fourteen (14) days' prior notice before such changes take effect. Non-material amendments (such as corrections of typographical errors or updates to contact details) shall be effective upon posting. Your continued use of the Services following any amendment constitutes acceptance of the updated terms. Notices shall be deemed received when sent, whether or not actually read.
Entire Agreement
This Agreement (together with the Privacy Policy, Cookie Policy, and any additional terms and conditions referenced herein) represents the entire agreement of the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous agreements and representations, written or oral, including earlier versions of this Agreement. In the event of any conflict between this Agreement and any other terms or policies, this Agreement shall prevail unless expressly stated otherwise.
